Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the bank statement conversion service (the “Service”) provided at bankpdfconverter.com (the “Website”) by us (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

• Account: The user account you create by registering with a valid email address.
• Service: The bank-statement PDF to CSV or Excel conversion functionality offered on the Website.
• Website: bankpdfconverter.com, including all associated subdomains.
• Subscription: The paid plan you select (monthly or annual) that determines your Credits allowance per month.
• Billing Cycle: The recurring interval (e.g., monthly or annually) at which Subscription fees are charged, as displayed during checkout and in your account dashboard.
• Credits: Processing units; processing one page of a PDF consumes one Credit.
• Uploaded Files: Bank-statement PDF files that you upload to the Service.
• Converted Files: The CSV and/or Excel files generated from your Uploaded Files.
• Privacy Policy: Our separate privacy policy, located at bankpdfconverter.com/privacy.

2. Acceptance & Amendments

Your use of the Service constitutes acceptance of these Terms. We may amend these Terms at any time by posting updated Terms on the Website with a new “Last Updated” date. Your continued use of the Service after such posting constitutes acceptance of the revised Terms.

3. Account Registration & Security

You register for an Account using a valid email address. You are responsible for the security of your Account, including the email used to access it, and all activity under your Account. You must be at least 18 years old to use the Service.

4. Service Description, Credits, & License

The Service converts bank statement PDFs into CSV and Excel formats. Your Account's Subscription allows a certain number of Credits per month; processing one PDF page consumes one Credit. Unused credits do not roll over to the next month. We grant you a limited, revocable, non-exclusive license to access and use the Service strictly in accordance with these Terms.

5. Billing & Cancellation

• Subscriptions are billed monthly or annually by credit card through Stripe Inc.
• You may cancel at any time through your account dashboard on the Website and you will not be billed again. You will still be able to use the Service through the remainder of your paid period.
• All subscription fees are non-refundable except as required by applicable law.
• You represent that you have the legal right to use any payment method you provide and that all billing information is accurate.
• Chargebacks through your credit card provider may result in permanent blocking of your Account and forfeiture of any remaining Credits. Please contact us before taking such action.
• We may change Subscription prices for future renewal terms by giving you at least 30 days’ notice via email or dashboard alert. The new price will take effect on your next Billing Cycle unless you cancel before it starts.

6. Data Processing & Retention

Our handling of personal data, including retention, deletion, and sub-processor usage, is described in our Privacy Policy.

7. Third-Party Services

We use third-party providers—such as payment providers like Stripe Inc., hosting providers like Cloudflare Inc., etc.—to provide, operate, maintain, and support the Service. Your data is shared with such providers only as strictly necessary to provide, operate, maintain, and support the Service.

8. Support

Need help? Email support@bankpdfconverter.com. We aim to reply within 24 business hours. No formal uptime guarantee is provided.

If any conversion doesn't meet your expectations, please contact us and we'll work to improve the conversion for your statement format.

9. Feedback

Thank you for your ideas! If you submit feedback, you grant us a royalty-free, worldwide, irrevocable, perpetual license to use it. We aren't required to acknowledge, implement, credit, or compensate for feedback.

10. Intellectual Property

• You retain all rights to your Uploaded Files and Converted Files.
• We retain all rights, title, and interest in and to our Service, Website, software, trademarks, copyrights, and documentation.

11. Prohibited Conduct

You agree not to:

• Use the Service for unlawful or unauthorized purposes.
• Infringe or misappropriate any intellectual property rights.
• Reverse-engineer, decompile, or tamper with the Service.
• Abuse or overload the Service or its infrastructure.
• Distribute spam, malware, or malicious content.
• Upload or process data that you have no lawful basis to process (e.g., personal data without consent under GDPR, cardholder data under PCI-DSS, or protected health information under HIPAA).
• Attempt to bypass or defeat any security or rate-limit mechanism.
• Upload or process any file unless you have all necessary rights, licenses, and permissions to do so, and you warrant that converting them through the Service will not infringe any third-party rights.

12. Experimental Features

Features we label Alpha/Beta are provided AS IS, may change or disappear without notice, and are excluded from any support targets we voluntarily provide.

13. No Warranty; Accuracy & Professional-Advice Disclaimer

THE SERVICE, WEBSITE, AND ALL CONVERTED FILES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

The Service performs programmatic data extraction and does not constitute accounting, tax, investment, or legal advice. You are solely responsible for verifying the accuracy, completeness, and suitability of all Converted Files before relying on them for any purpose.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR (A) ANY LOST PROFITS, REVENUE, DATA LOSS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, OR (B) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE DURING THE TWELVE (12)-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

15. Indemnification

If a third party brings a claim against us arising from (a) your breach of these Terms, (b) your Uploaded Files, or (c) your use of the Service, you agree to defend, indemnify, and hold us harmless from and against all losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of such claim.

16. Service Changes, Suspension & Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will use commercially reasonable efforts to give advance notice for materially adverse changes.

We may also suspend or terminate your Account at any time for non-payment, abuse, or other policy violations, or at our discretion. You may request any data still available in your dashboard before it is deleted.

Any provision that, by its nature, should survive termination will do so, including, but not limited to, disclaimers of warranty, limitations of liability, indemnities, and dispute-resolution provisions.

17. Dispute Resolution

Except for disputes in small claims court (where you or we may proceed individually), any other dispute will be submitted to binding arbitration under the Federal Arbitration Act administered by the American Arbitration Association under its Commercial Arbitration Rules. You and we each waive the right to a jury trial and to participate in any class, collective, or representative action. Nothing in these Terms prevents either party from seeking injunctive relief in a court of competent jurisdiction.

Arbitration shall be conducted by a single arbitrator, in English, with the seat of arbitration in San Juan, Puerto Rico. The arbitrator may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

18. Governing Law & Venue

These Terms and any disputes arising under them are governed by U.S. federal law and the laws of Puerto Rico, without regard to conflict-of-laws rules.

19. Assignment & Change of Control

We may assign or transfer these Terms (for example, in connection with a sale or merger). You may not assign or transfer your Account or rights without our prior written consent.

20. Miscellaneous

• Headings: The headings in these Terms are for convenience only and do not affect the interpretation of these Terms.
• Taxes: Subscription fees exclude all applicable taxes, duties, or levies, which are your responsibility.
• Third-Party Links: The Website or blog may contain links to third-party sites or resources that we do not own or control. We are not responsible for the content, availability, or practices of those third parties and disclaim any liability arising from your use of them. We recommend you review the terms and privacy policies of any third-party site you visit.
• Export Controls: You may not access or use the Service if you are located in, or a resident of, a country embargoed by the United States, or if you are on the U.S. Treasury Department's list of Specially Designated Nationals.
• Marketing Emails: We may send you product updates or promotional emails; you can opt-out at any time by clicking the unsubscribe link in the email.
• Publicity: You grant us a limited, non-exclusive, royalty-free license to display your name and logo on our customer list, website, and other marketing materials. If you prefer we not do so, email support@bankpdfconverter.com and we will cease any new public use of your marks within 10 business days.
• Notices: We will send any notices to the email address associated with your Account. You may send any notices to support@bankpdfconverter.com.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• Waiver: Failure to enforce any right is not a waiver of that right.
• Entire Agreement: These Terms (and our separate Privacy Policy) are the complete agreement.
